Spinal Cord Injury Lawyer in Kentucky
Spinal cord injuries (sometimes abbreviated SCI) are serious injuries that can change someone’s life forever. Spinal cord injuries are not the same as neck and back injuries -- these injuries specifically affect your spinal cord, not simply the bones of the spine that are designed to protect it.
While some diseases may cause spinal cord injuries, they are typically as a result of accidents or assault, including:
- Trucking accidents on the Interstate
- Car accidents
- Motorcycle accidents
- Slip and fall accidents
- Premises liability
- Defective products
- Industrial or construction accidents
- Complications from medical procedures
- Shootings
- Assault
Types of Spinal Cord Injuries
Spinal cord injuries are broken down into two types: complete and incomplete.
Incomplete SCIs involve some retention of sensation below the site of injury, whereas complete SCIs result in no sensation below the site of injury. Incomplete SCIs are less severe, but it can still reduce someone’s ability to, for example, affect their ability to work and earn an income.
Complete SCIs are far more traumatic, and they are divided into two categories: tetraplegia and paraplegia.
Tetraplegia (aka Quadriplegia) is the loss of sensation and control of both arms and legs, while paraplegia is limited to only the legs.
The human spine is divided into three primary regions (see image to the right):
- Cervical spine (red) - the C1-C7 form the neck
- Thoracic spine (blue) - the Th1 to Th12 are the upper and mid back
- Lumbar spine (yellow) - the L1-L5 are the lower back
Injuries to the cervical spine may result in Tetraplegia/Quadriplegia. Injuries below this won’t affect the arms, so SCI injuries originating in the thoracic and lumbar spines would only affect the legs. The higher up the point of injury, the worse the injury will be.
Building Your Personal Injury Case
If you or a loved one have been injured in an accident and sustained a spinal cord injury, it is imperative that you seek an experienced Kentucky spinal cord injury lawyer as early as possible after the accident. An experienced attorney can help you ensure that you or your loved one are not only receiving the full medical attention you may require, but they will also help you ensure that you are properly documenting everything you need to make your case successful.
In most cases, compensation for injuries will be left to an auto or business liability insurance company, and their job is to pay you as little as they can.
Because of the severity -- particularly of full spinal cord injuries -- the injured parties may be entitled to more than the typical categories for compensation. They include, but are not limited to:
- Lost wages
- Loss of earning capacity
- Medical bills and future medical expenses
- Long-term care
- Physical therapy
- Pain and suffering
- Emotional Distress
An experienced Kentucky spinal cord injury attorney will help you sort through the specific details of your case, help you understand what compensation you are entitled to, and will have experience in dealing with insurance companies to make sure they pay you what you deserve.
