Defective Seats - Kentucky Defective Auto Products Lawyers
Most people never consider how the seats in their vehicle can contribute to the severity of injuries in a car accident. However, vehicle seats should always be designed to reduce the risk of serious injuries in collisions. When a seat is defective, it can actually contribute to the seriousness of injuries in an accident, or even cause fatalities. While some defective seats have been recalled by manufacturers, others are still in use and can cause catastrophic injuries or death.
Types of Defects in Automobile Seats
There are typically three ways that defective seats can actually cause more serious injuries in a car accident.
Defective Seatbacks
A car accident oftentimes creates a tremendous amount of pressure from the occupant pressing back into the seatback. If the seatback breaks, bends, or collapses backward during an accident, the driver or passenger no longer has any protection from his or her seat belt or airbag. This can mean that an occupant is either ejected from the crash or crushed. Even back seat occupants of a car can suffer serious injury or death if the front passenger or driver’s seatback fails or malfunctions in any way causing them to slam into the back seat passengers during a collision. Additionally, if the seatback collapses backward, the driver is unable to steer the vehicle correctly causing a loss of control of the car.
Flawed Headrests
If a seat does not have an adequate or appropriate headrest, it can significantly increase a driver’s or passenger’s chances of developing serious injuries related to a car accident. Many car accidents involve the sudden stopping of a vehicle as the impact occurs. This can increase the risk of whiplash, neck injuries, head injuries, and traumatic brain injuries.
Defective Seat Tracks
Every seat in the front of a vehicle is on a specific track which allows it to move forward and backward with respect to the occupants’ preference. If the seat is not working properly or correctly on this track, or if the track is in some way faulty or defection, during an accident, the seat may completely move toward the front or back of the track during the incredible force of the collision. This can cause catastrophic injuries to a victim’s head and neck, and even cause internal organ damage and bleeding. In some cases, the spine is so injured, it leaves victims paralyzed. Additionally, this movement forward can be so powerful that if it is accompanied by an inflating airbag, it can result in fatalities.
